The Spanish National Commission of Markets and Competition is currently carrying out a public consultation of the Draft Guide for the Quantification of Damages for Competition Infringements, in order to assist judges and courts and to increase the technical rigor of the expert reports.
The Draft focuses on the most commonly used quantification methods and tries to simplify the technical language used in the Commission’s 2013 Practical Guide and in the 2009 Oxera Report, and includes a compilation of the most recent Spanish judgments on the subject, as well as a list of the most relevant recent bibliography. It would be important for the judges involved to send their observations to the CNMC to prevent the future instrument from failing.In any case, the CNMC’s initiative is to be welcomed and should be followed by other competition authorities of the different member states of the European Union.
